At FitEBC.com we take the collection and handling of our customers’ personal data very seriously and this Privacy Policy outlines our ongoing obligations to you, our customer, in respect of how we manage your personal information.

As an Australian based organisation, FitEBC’s approach to collecting and handling your personal information is done in accordance with the 13 Australian Privacy Principles (APPs) as contained in the Privacy Act 1988.

What is Personal Information?

Personal information is information or an opinion, whether true or not, and whether recorded in a material form or not, that identifies an individual or can be used to reasonably identify an individual.

What We Collect

We collect your personal information such as your name, addresses, Email and telephone number for the primary purposes of providing products and services to you, improving your customer experience and marketing. We have no need for and do not collect any ‘sensitive’ personal information (e.g. ethnicity, health or sexual orientation data).

Where reasonable and practicable to do so, we will only collect your personal information directly from you. However, in some circumstances, we may collect personal information from a third party or from a publicly available source. We only collect personal information from third-party sources that are allowed to disclose such information to us, and in such instances, we will take reasonable steps to ensure that you are made aware of any information provided to us by the third party.

Here is a list of the types of personal information we collect from you, together with an explanation of why we are collecting the information and how we plan to use it:

Newsletter Mailing List

If you subscribe to our mailing list, this means you have opted in and have consented to us sending you emails that contain information on the products and services we provide as a company. All emails we send are in line with the Spam Act 2003 which can be viewed on the Australian Communications and Media Authority website. We will not spam mail you. You can unsubscribe from our newsletter mailing list at any time by clicking ‘unsubscribe’ in the email footer or by managing your notification preferences in your My Account area (if you have a user account with us).

User Contact Forms

When you fill out a contact form or send an Email to us, we will use the supplied information to respond to your query. We may also share this information with our brand partners from time to time, some of whom may be located outside Australia, if it is helpful in resolving your query.

We may also keep your emails on internal record for training purposes and to improve our products and services.

Creating ‘My Account’

If you create a ‘My Account’ with us, we will collect your personal information and store your preferences for the purposes of improving your shopping experience with us. Any personal information stored by us, including your notification preferences, can be easily edited by clicking the ‘Manage Account’ link in the footer.

Credit Card Payments

We use one of the world’s largest and most secure payment gateway providers, Stripe, for online payments. When you process your payment through Stripe, FitEBC.com only receives basic information and a confirmation of payment receipt (we do not come into contact with your credit card details for payments processed via this method).

On the rare occasion you make a payment to us via a method other than Stripe, we may come into possession of your credit card details so that we can process that payment. In such instances, all credit card information will be held for the minimum period possible and will be destroyed/deleted as soon as the payment has gone through.

Direct Marketing

We all know how frustrating it is to have your inbox spammed with non-personalised junk Emails. That’s why FitEBC.com promise we won’t do it.

We will only contact you with targeted promotions that we feel you’ll be interested in, using in-house code that looks at your purchase history together with any vehicles saved in your ‘My Garage’ area to recommend new products and deals that we feel are genuinely useful to you.

If we’ve got nothing useful to send to you, then we won’t send anything at all, and if at any point you’re unhappy with our approach to direct marketing then you can manage your notification preferences in your ‘My Account’ area or simply hit the unsubscribe link at the bottom of any Email.

Payments

FitEBC.com use Stripe to process online payments. Stripe is a level 1 PCI service provider and uses best-in-class security tools, including credit card number encryption, to safeguard your personal information. Rest assured, when you shop with FitEBC.com the checkout process is completely secure.

All payment information entered at the checkout stage is sent directly to Stripe and is not stored on our systems. To find out more about how Stripe manages your personal information you can view Stripe’s Privacy Policy.

Data Security

The security of your personal information is a key priority for FitEBC.com and we take active steps to safeguard it against loss, unauthorised access, unauthorised modification, unauthorised disclosure or against any kind of misuse. We have put in place suitable administrative, technical and physical safeguards to secure the information we collect.

When no longer required for the purpose for which it was obtained, or at your request, personal information is destroyed in a secure manner. However, most of the personal information that we collect is or will be stored in client files kept by us for a minimum of 7 years.

Disclosure

We only use your personal information for the purpose requested of us, or for purposes which directly relate to our operations as outlined in this privacy policy. We will not provide your information to third parties unless one of the following applies (as per APP 6 – use and disclosure of personal information):

• You have consented
• You would reasonably expect, or have been informed that your personal information would be passed on to those third parties.
• It is required or authorised by law, or reasonably necessary for the enforcement of criminal law or of a law imposing a pecuniary penalty, or for the protection of public revenue.
• It may prevent or lessen a series and imminent threat to somebody’s life or health.

Cross-Border Disclosure

Occasionally we may disclose your personal information to other entities who are located outside Australia. For example, we routinely share customer feedback with our European brand partners for the purpose of improving their products and services, and occasionally this information may not be de-identified (e.g. the forwarding of a customer Email review or complaint). We may also share name and email address details with marketing agencies in the United Kingdom to assist us in our marketing activity.

These European entities are themselves governed by GDPR, which is generally considered to be equivalent to or above the privacy requirements as set out in the APPs, however, FitEBC.com additionally ensures that every cross-border entity we may disclose personal information to conforms to the standards as set out in the APPs as a minimum.

Right to Access & Correction

At any time you can request access to the personal information we hold about you by emailing our Privacy Officer at sales@fitebc.com. Please note that, under Australian privacy laws, there may be instances where we cannot provide access to all personal information, for instance if its disclosure reasonably affects someone else’s privacy or poses a threat to someone’s life, health or safety.

At FitEBC.com we take pride in ensuring any personal information we hold is accurate and up to date, therefore if you find any of the information we hold about you is incorrect we encourage you to correct it. If you have a ‘My Account’ with us, you can freely and easily edit your personal information yourself via the ‘Manage Account’ link in our footer. Alternatively, if you need help correcting your personal information you can email us at sales@fitebc.com.

Cookies & Analytics

FitEBC.com uses cookies which are combined with your personal information to track user traffic patterns and provide tailored content that improves your customer experience.

FitEBC.com also uses web analytics tools, such as Google Analytics, for measuring website advertising performance. To find out more how Google Analytics uses the cookies and anonymous identifiers it collects please refer to Googles own privacy policy.

Making a Complaint
